TERMS OF SALE

1. Validity of the terms of sale

1.1. These Terms of Sale govern the rights and obligations arising between the client of the Nanails Online Store (hereinafter referred to as the Buyer) and NaNa OÜ (hereinafter referred to as Nana) when purchasing goods (hereinafter referred to as the Goods / Goods).

1.2. In addition to these terms and conditions, the legal relationship arising from the purchase of Products from the Nanails online store is governed by the legislation in force in the Republic of Estonia.

1.3. Nanails reserves the right to change the terms of sale and prices for the Product being sold. These changes are displayed on the Nanails web page www.nanails.eu.

1.4. By accepting these terms and conditions, the Buyer confirms that he has read the Terms and Conditions of the Sales Agreement, agrees with them and undertakes to comply with them.

2. Prices

2.1. All prices quoted in the Nanails Online Store include 20% VAT.

2.2. Percentage discounts shown have been rounded to the nearest whole number.

3. Checkout

3.1. On the Nanails web page, you can buy Products that have an “Add to Cart” icon. To purchase the desired Product, add it to your shopping cart.

3.1.1. Professional products are only available to Nanails registered and Nanails verified business customers in the beauty services industry. For more information, please write to info@nanails.eu

3.2. Product price and availability are subject to change without notice.

3.2.1. The availability of the Goods can be checked by clicking on the text “Available” under the specific Goods.

3.2.2. Product prices are displayed on the Product page. If the Product has a discount, then the Product page displays both the discounted price and the total cost of the product.

3.3. The buyer can familiarize himself with the contents of his basket by clicking on the “Basket” icon at the top of the page.

3.3.1. The quantity of the Goods in the basket can be changed by writing the desired quantity of the Goods in the specially designated column.

3.3.2. You can remove an item from the cart by clicking on the “cross” located in the same row with the item.

3.4. Before placing an order, you must choose the appropriate delivery method.

3.4.1. For orders over 50 €, delivery of goods in Estonia is free.

3.5. To place an order, you must click the “Checkout” icon.

3.6. Confirm the order by clicking “Order / Pay”.

3.6.1. You will be issued a prepayment invoice, which must be paid by credit card, bank payment or bank link.

3.6.2. Confirmation of the order (invoice for prepayment) is sent to the Buyer’s email address.

3.6.3. You can check your purchase history and invoices at any time in the “My Profile” section.

3.7. The goods will be sent after payment of the invoice.

4. Entry into force of the sales contract

4.1. By clicking the “Order / Pay” button, the Buyer undertakes to accept and pay for the order.

4.2. The sales contract comes into force from the moment the prepayment amount indicated in the invoice is received to the current account of Nana OÜ.

5. Delivery and transfer of goods

5.1. After the entry into force of the sales contract (after the Buyer has paid the prepayment invoice), Nanails completes the order and transfers it to its logistics partners for delivery to the Buyer.

5.2. Orders that have been issued and the prepayment for which was received on the Nanails current account on working days before 13:00 will be delivered to the Buyer the next day or according to the delivery time indicated on the product card.

5.2.1. It may take up to 3 business days for orders to be delivered to the islands.

5.3. In order to avoid delays in delivery, the Buyer must make sure in advance that the entered contact information is correct.

5.4. In the event that replacement of the Goods is not possible, Nanails will reimburse the Buyer for the cost of the Goods.

5.5. Nanails shall not be held liable for delayed delivery of the Products in the event that the Products are handed over to the logistics partner in a timely manner, but the delay in delivery is due to circumstances that Nanails could not influence or foresee.

5.6 Nanails is not responsible for products where the consistency of the liquid or any other condition of the product may be affected by the ambient temperature during the arrival of the Product in the packaging machine.

6. Right to return

6.1. Items purchased from the Nanails Online Store are eligible for a 14-day return right. If the Products purchased in the online store do not suit the Buyer, he has the right to return the Products to the store without giving any reason.

6.1.1. The period for returning the goods expires after 14 days from the day when the Buyer or the Buyer trusted third party, which is not a logistics partner, physically took possession of the item.

6.2. The right of return does not apply to:

6.2.1. goods that are inherently non-returnable and that were delivered in unopened packaging, but the packaging was opened by the customer;

6.2.2. goods that cannot be returned after opening the package for health or hygiene reasons;

6.2.3. goods for which it is not possible to establish the fact of opening the package or not using the product for Nanails (for example, there is no protective foil / film under the lid);

6.2.4. goods that were manufactured in accordance with the conditions provided by the Buyer;

6.2.5. goods that have been mixed or combined with other goods or products after delivery in such a way that they can no longer be separated;

6.2.6. a product that has been used for commercial or professional purposes.

6.3. Nanails will immediately refund the money to the Buyer for the returned Product, but no later than within 14 days from the date of receipt of the message of the relevant content from the Buyer.

6.3.1. The costs associated with the return of the Goods are borne by the Buyer, unless the reason for the return is that the Goods to be returned do not correspond to the order (incorrect or defective goods).

6.4. The Buyer undertakes to immediately return the Product to Nanails, but no later than 14 days from the date of notification to Nanails of his desire to return the Product. The product can be returned:

6.4.1. to the Nanails store in Tallinn, Pärnu maantee 23;

6.5. The deadline is considered met if the Buyer returns the Goods before the expiration of the 14-day period.

6.6. Nanails may delay payment of refunds until it receives the Goods from the Buyer or documented evidence that the Goods were shipped by the Buyer, whichever comes first.

6.7. If the Buyer wants to avoid compensation for damage for a decrease in the value of the Goods, then the Goods should be used and its performance checked in the same way as he would be allowed to do this in a regular store before buying. The Product must be returned in its original packaging and complete set (with all the constituent parts of the Product and gifts from Nanails). If the Buyer has used the Product more than is necessary for familiarization, verification of its properties and performance, or returns the Product not in its original packaging and incomplete complete set, then the Buyer is responsible for reducing the cost of the Product.

6.7.1. In the event of a deterioration in the condition of the returned Goods, the Buyer is responsible for reducing the value of the Goods, provided that the Goods have been used by them more than necessary for familiarization, verification of its properties and performance. Familiarization with the characteristics and performance of the purchased Product should take place in the same way as he would be allowed to do it in a regular store before buying.

6.8. Nanails has the right to demand from the Buyer compensation for damage for the reduction in the value of the Goods no later than one month from the date of the return of the Goods.

6.9. If the Buyer has used or tested the functionality of the Product to be returned in a different way than is permissible in a regular store, or used the Product more than necessary to familiarize, check its properties and performance, the Buyer is responsible for reducing the cost of the Product and Nanails has the right to deduct the amount of damage from the subject return of the cost of the Goods. If the Buyer does not agree with the decrease in the cost of the goods indicated by Nanails, then he has the right to turn to an independent expert for help. The services of an independent expert will be paid by the party whose position is not confirmed. If it turns out to be impossible to find out such a party, then the costs of the examination are divided between the Buyer and Nanails in half.

7. Force majeure

7.1. Nanails is not liable for any damage caused (including damage to the Goods due to hypothermia or overheating, see 5.6) or delayed delivery of the Goods if the damage or delay is due to circumstances beyond which Nanails could influence.

8. Protection and security of personal data

9. Processing and security of personal data

9.1. All personal data of the Buyer / Client, published during the visit to the Nanails online store and during the shopping process, is treated as confidential information. Except when the courier needs the Buyer’s / Client’s name, phone number and delivery address to deliver the order, or in other cases established by law.

9.2. An encrypted data transmission channel ensures the security of personal data and bank details. Nanails Online Store does not have access to this data.

10. Other conditions

10.1. Product images are for illustrative purposes only.

10.2. Product prices and availability are subject to change without notice. In this case, Nanails reserves the right to refuse the sale and return the money to the Buyer to his bank account within a reasonable time.

10.3. Information about the Goods is regularly checked and updated. The data can be updated from the moment it was last viewed by the Buyer.
